Delayed Delivery Causes Permanent Neurological Injury

A federal judge has ordered the government to pay $4 million of a birth injury settlement involving Temple University Hospital. An obstetrician there (employed by the federal government) waited three hours to see his patient, who arrived at the hospital at 37 weeks pregnant and was experiencing decreased fetal movement. The delay resulted in an emergency Caesarean section for the delivery.

The doctor in question has been accused on medical malpractice. The baby was born with permanent neurological injuries, including global development delay, visual impairment, dysphagia, seizure disorder, spasticity, quadriplegic pattern cerebral palsy and microcephaly. The parents of the baby initially demanded $100 million in damages when filing suit against the hospital. Temple University Hospital decided to settle rather than take the fight to the courtroom. The $8 million figure encompasses the costs of the baby’s lifelong care.

The judge found that the government and Temple University Hospital shared equal liability in the case, and demanded they split the settlement.
